你好，我租房的时候和房东签了一年的租房合同，合同到期后和房东电话沟通临时短期续租，暂时交了3个月租金，多退少补。住了2个月后决定搬离，但是房东以没有签合同为由不退剩下的1个月租金，当时是支付宝转账只有转账记录，请问能否通过正常途径要回，谢谢。
