的确应该在房屋买受人的人手中
可是，你们是否看见房产证
你们的用按揭贷款方式购买房屋
在房产证的“其他权利设定”中会有放贷给你们的银行名称
银行在房产部门发证时就已经设定他项权登记了
所以，银行不会扣留你的证件
房产部门是发证机关，只要符合发证要求
他们也不会扣留你们的房产证

那就是开发商没有办理下来
只不过是在推托罢了
建议，直接向开放商催要！他们是有义务协助你们的！
