对税务局不服，可以向做出处罚决定的上一级部门（单位）做出复议。依法具有独立行政执法主体资格的分局，复议机关是市局。除此，视为属于市局自身的执法行为，复议机关是市政府。国税局属于垂直领导的行政机关。因此，对于县国税局作出的税收有关的决定不服的，应当向上一级国税机关申请行政复议，也就是向市国税局申请。对海关、金融、国税、外汇管理等实行垂直领导的行政机关和国家安全机关的具体行政行为不服的，向上一级主管部门申请行政复议。哪些行政机关可以作为行政复议机关，也就是具体行政复议案件由哪个行政机关管辖，按照行政复议法规定，一是向作出具体行政行为的行政机关的上一级地方人民政府申请行政复议。二是作出具体行政行为的市县级以上地方各级人民政府工作部门的，当事人可以作出选择，可以向该部门的本级人民政府申请行政复议，也可以向上一级主管部门申请行政复议。比如，要对县公安局的决定申请行政复议，当事人可以找县政府，也可以找上一级公安部门。税务行政复议范围税务行政复议范围：(一)税务机关作出的征税行为包括确认纳税主体、征税对象、征税范围、减税、免税、退税、抵扣税款、适用税率、计税依据、纳税环节、纳税期限、纳税地点和税款征收方式等具体行政行为，以及征收税款、加收滞纳金，扣缴义务人、受税务机关委托的单位和个人作出的代扣代缴、代收代缴、代征行为等。(二)行政许可、行政审批行为。(三)发票管理行为，包括发售、收缴、代开发票等。(四)税务机关作出的税收保全措施、强制执行措施。(五)税务机关作出的行政处罚行为：1。罚款；2。没收财物和违法所得；3。停止出口退税权。(六)税务机关不依法履行下列职责的行为：1。颁发税务登记证；2。开具、出具完税凭证、外出经营活动税收管理证明；3。行政赔偿；4。行政奖励；5。其它不依法履行职责的行为。(七)税务机关作出的资格认定行为。(八)税务机关不依法确认纳税担保行为。(九)政府信息公开工作中的具体行政行为。(十)税务机关作出的纳税信用等级评定行为。(十一)税务机关作出的通知出入境管理机关阻止出境行为。(十二)税务机关作出的其他具体行政行为。纳税人认为税务机关的具体行政行为所依据的规定不合法，对具体行政行为申请行政复议时，可以一并向行政复议机关提出对有关规定的审查申请。前款中的规定不包括规章。希望以上内容能对您有所帮助，如果您还有其它问题请咨询专业律师。【法律依据】：《中华人民共和国行政复议法》第十二条对县级以上地方各级人民政府工作部门的具体行政行为不服的，由申请人选择，可以向该部门的本级人民政府申请行政复议，也可以向上一级主管部门申请行政复议。
