第十二届全国人民代表大会常务委员会第二十四次会议审议了委员长会议提请审议《全国人民代表大会常务委员会关于〈中华人民共和国香港特别行政区基本法〉第一百零四条的解释(草案)》的议案。经征询全国人民代表大会常务委员会香港特别行政区基本法委员会的意见,全国人民代表大会常务委员会决定,根据《中华人民共和国宪法》第六十七条第四项和《中华人民共和国香港特别行政区基本法》第一百五十八条第一款的规定,对《中华人民共和国香港特别行政区基本法》第一百零四条“香港特别行政区行政长官、主要官员、行政会议成员、立法会议员、各级法院法官和其他司法人员在就职时必须依法宣誓拥护中华人民共和国香港特别行政区基本法,效忠中华人民共和国香港特别行政区”的规定,作如下解释:
一、《中华人民共和国香港特别行政区基本法》第一百零四条规定的“拥护中华人民共和国香港特别行政区基本法,效忠中华人民共和国香港特别行政区”,既是该条规定的宣誓必须包含的法定内容,也是参选或者出任该条所列公职的法定要求和条件。
二、《中华人民共和国香港特别行政区基本法》第一百零四条规定相关公职人员“就职时必须依法宣誓”,具有以下含义:
(一)宣誓是该条所列公职人员就职的法定条件和必经程序。未进行合法有效宣誓或者拒绝宣誓,不得就任相应公职,不得行使相应职权和享受相应待遇。
(二)宣誓必须符合法定的形式和内容要求。宣誓人必须真诚、庄重地进行宣誓,必须准确、完整、庄重地宣读包括“拥护中华人民共和国香港特别行政区基本法,效忠中华人民共和国香港特别行政区”内容的法定誓言。
(三)宣誓人拒绝宣誓,即丧失就任该条所列相应公职的资格。宣誓人故意宣读与法定誓言不一致的誓言或者以任何不真诚、不庄重的方式宣誓,也属于拒绝宣誓,所作宣誓无效,宣誓人即丧失就任该条所列相应公职的资格。
(四)宣誓必须在法律规定的监誓人面前进行。监誓人负有确保宣誓合法进行的责任,对符合本解释和香港特别行政区法律规定的宣誓,应确定为有效宣誓;对不符合本解释和香港特别行政区法律规定的宣誓,应确定为无效宣誓,并不得重新安排宣誓。
三、《中华人民共和国香港特别行政区基本法》第一百零四条所规定的宣誓,是该条所列公职人员对中华人民共和国及其香港特别行政区作出的法律承诺,具有法律约束力。宣誓人必须真诚信奉并严格遵守法定誓言。宣誓人作虚假宣誓或者在宣誓之后从事违反誓言行为的,依法承担法律责任。

十二届全国人大常委会第二十四次会议5日下午举行分组会议,审议全国人大常委会关于香港特别行政区基本法第一百零四条的解释草案。
出席会议的常委会组成人员和列席会议的全国人大各专门委员会成员、各省(区、市)人大常委会负责人、全国人大代表普遍认为,对香港基本法第一百零四条作出解释十分及时、非常必要。近年来,香港社会出现了一股“港独”思潮,一些人打出“港独”旗号,成立“港独”组织,甚至进行非法暴力活动。在不久前进行的香港特区第六届立法会议员就职宣誓仪式上,少数候任议员故意违反宣誓要求,公开宣扬“港独”,侮辱国家和民族,被裁定宣誓无效后,仍然强闯立法会,致使立法会无法正常开会。这些言行公然挑战基本法,阻碍了香港特区政权机构的正常运作,破坏了香港的法治,冲击了“一国两制”的原则底线,对国家主权、安全造成了严重威胁。这类状况持续下去,必然损害香港特区广大居民的切身利益和国家发展利益,中央不能坐视不管。全国人大常委会及时作出法律解释,是依法行使宪法和香港基本法赋予的职权,符合宪法和基本法的规定,建议本次常委会会议审议通过。
与会人员一致认为,全国人大常委会所作的法律解释与基本法具有同等效力,解释草案阐明的就职宣誓规定的立法含义和法律原则,有利于澄清香港社会的模糊认识,是维护基本法权威、保持香港大局稳定的需要,香港特区的行政机关、立法机关和司法机关都必须一体遵循。
与会人员还对解释草案的具体内容进行了充分讨论。

该发言人说,今天上午,全国人大常委会针对香港特别行政区立法会选举及个别候任议员在宣誓时宣扬“港独”主张,侮辱国家、民族引发的问题,对基本法有关条文作出解释,明确了依法宣誓的有关含义和要求。全国人大常委会的这一解释,表明了中央政府反对“港独”的坚定决心和意志,维护了基本法的权威和香港法治,顺应了包括香港同胞在内的全体中国人民的共同愿望,完全必要,正当其时。
该发言人说,香港特别行政区是直辖于中央政府的地方行政区域,立法会是按照香港基本法设立的特别行政区立法机关。全国人民代表大会常务委员会有关基本法的解释与基本法具有同等法律效力。基本法的有关规定和全国人大常委会的解释必须在香港特别行政区得到不折不扣的执行,绝不允许在香港从事任何分裂国家的活动,也绝不允许“港独”分子进入特别行政区的政权机关。
发言人最后说,中央政府相信香港社会各界会进一步清醒地认识到“港独”的危害性,珍惜和维护香港稳定发展的良好局面,全面准确贯彻“一国两制”方针和香港特别行政区基本法,维护国家主权、安全和发展利益,保持香港长期繁荣稳定。

中央政府驻香港联络办公室主任张晓明6日表示,不久前香港立法会部分候任议员在就职宣誓时的恶劣表现,已经严重触碰“一国两制”的底线,违反国家宪法、基本法和香港有关法律的规定,危害国家的统一、领土完整和主权安全,性质严重、影响恶劣。中央政府依法采取有效措施打击和遏制“港独”势力滋长蔓延,立场鲜明、态度坚决,绝不会容许“港独”分子就任立法会议员。
当日下午,张晓明与部分港区全国人大代表、全国及省市区政协委员等约200人会面,向大家通报了全国人大常委会即将对基本法第一百零四条进行解释的有关情况及考虑。
张晓明重点阐述了这次人大释法的正当性。他表示,从释法的目的来说,这次释法主要是针对“港独”问题,通过把好依法宣誓关,打击和遏制“港独”活动,维护国家安全,这是天经地义的;从释法的方式来说,人大常委会完全有权也有责任主动释法;从释法的实际需要来说,香港特别行政区立法会内部、立法会主席与特区政府之间以及香港社会都已出现较大争议,并严重影响到立法会运作,释法确有必要。
他接着指出,从释法的时机来说,由于法院审理案件的持续时间以及判决结果都有不确定性,加之有关判决会引发行政、立法机关和法院联动,惟有在本次全国人大常委会会议上及时释法,才能确保避免产生更为严重的后果;从释法的影响来说,释法不仅仅是针对这次宣誓风波,也不完全是针对法院判决,而是对今后所有相关公职人员的宣誓和特区行政、立法、司法机关今后处理宣誓中出现的各类问题,都可提供普遍、清晰的依据和指引,并可以起到正本清源、息纷止争、划明底线、完善制度等作用。
张晓明强调,中央政府一直珍视香港的法治。关键是在我们谈论香港法治的时候,一定不要把基本法撇在一边。基本法是香港特别行政区的宪制性法律,是香港法律体系中位阶最高的法律。香港基本法对于在“一国两制”下中央享有哪些权力、特区享有哪些权力、它们之间的关系怎么协调,已经作了总体设计,并有明确规定。
他指出,中央享有的权力与特区享有的各种高度自治权是两个层面的权力,其运行并行不悖。真正尊重和遵守基本法,就要既尊重香港特别行政区的高度自治权包括独立的司法权和终审权,维护香港的司法独立,又要尊重中央依法享有的各项权力包括解释基本法的权力,把全国人大常委会释法当做香港法律制度的重要组成部分,把香港的司法权和司法独立置于“一国两制”和基本法的框架之下。

WATCHED from Beijing, where the national parliament never shows a glimmer of disloyalty to the Communist Party and its members usually rubber-stamp any bill, the swearing-in of Hong Kong’s recently chosen legislators on October 12th must have been unnerving. Even by the standards of Hong Kong’s far more querulous politics, the scene was striking. One legislator (pictured) draped himself in a banner saying “Hong Kong is not China” and crossed his fingers as he delivered the oath, which includes words that make clear the territory is part of it. Two others pronounced China in a derogatory way used by Japanese in imperial days. During the chaotic ceremony, the three were declared unqualified to take up their posts. Hong Kong’s legislature has entered a rocky new relationship with the central government that will fuel political tension in the territory.

The authorities in Beijing knew that such displays were likely. In elections for the Legislative Council (usually called Legco) that were held on September 4th, six people gained seats in the 70-member body who belong to a new political force known as “localists”. They say Hong Kong people should be allowed to decide what sort of relationship the territory has with China (they had no say in the matter when Britain handed Hong Kong over to China in 1997). As the banner sported during the swearing-in suggested, some localists are sympathetic with the idea of independence. A handful of the newly elected legislators said they would reflect this during the ceremony, either by adjusting the words of the oath or through other actions.

On the eve of the swearing-in, Hong Kong’s government (which sticks closely to the Communist Party’s line on such matters) issued an unprecedented warning that failure to take the oath in “a manner or form” consistent with the law would result in disqualification. It asked legislators to behave in an “orderly” way at the ceremony to allow Legco business to “commence without delay”.

With 40 seats in the new legislature, government supporters have a majority (helped by a voting system that skews the outcome in favour of pro-estab seearticle). But members of the pro-democracy minority, including the radical localists, clearly paid little heed to the last-minute attempt to keep them in line. One of them, Raymond Chan, tore up a copy of the warning before reading his oath in the harbour-front Legco building. The government, he said, had no right to interfere in Legco’s affairs.

Despite his gesture, Mr Chan’s oath was accepted by the clerk. Others, too, managed to get away with making anti-government statements before or after their oaths. One called for universal suffrage. Another recalled the Umbrella Movement of 2014, when thousands of Hong Kong residents blocked streets in busy commercial areas for 11 weeks to press their demands for full democracy in the territory (China’s parliament had ruled that the public could choose Hong Kong’s leader, but only from among candidates vetted by a committee packed with the party’s supporters). “We will put up resistance. We are back,” he said, jabbing his fist in the air. Two of those who failed to pass muster were localists. One was Sixtus Leung, the legislator who crossed his fingers. Another was Yau Wai-ching, who, like Mr Leung, began her oath by swearing allegiance to the “Hong Kong nation”. Also disqualified was Edward Yiu, who swore in his oath to “fight for genuine universal suffrage”.

It is not yet clear whether the three politicians will be barred permanently from taking up their seats. They were, however, excluded from the first item of business: electing Legco’s president. The winner was a pro-government candidate, Andrew Leung, but only after a stormy session in which legislators raised questions about his nationality and right to residency abroad (he has held British citizenship, but says he has given it up). Pro-democracy members tore up their ballots and left the chamber in protest.

The government in Beijing made its views clear in editorials that were published the day before the ceremony in newspapers in Hong Kong that it controls:Wen Wei PoandTa Kung Pao. Both warned that if court battles ensue between disbarred legislators and the government, and the courts cannot decide whether their oaths meet the requirements of Hong Kong’s constitution, then China’s parliament, the National People’s Congress, will adjudicate. Such an intervention would create a furore in Hong Kong, which prides itself on the independence of its judiciary.

It may also play into the hands of the localists, who took 19% of the vote in September’s elections—largely thanks to support from young people worried by what they see as the mainland’s growing control over the territory. Localism barely existed as a political force until the Umbrella Movement ended, having failed to extract any promises of full democracy.

At least one such challenge has already been filed. But the editorial inTa Kung Paosaid that no one should “underestimate the resolve and confidence of the central [authorities] in eliminating separatism”. The stage is set for growing antagonism between the party and the territory’s increasingly feisty politicians.

After days of uproar from all directions, they DO KNOW now. But they still refuse to apologize, saying they didn't do anything wrong, it was only their &accent&, whatever that is.
And of course it is government, or better Beijing's fault. Who else??
If lack of Chinese history in school is the problem, why is youngster like Mo Ka-kit of City University who is the same age of these fools knows the derogatory meaning and has gotten over 50,000 signatures to condemn the fools??
The Civic Party's lawyers, like Audrey Eu, Alan Leong etc. should know very well of the derogatory meaning at their 'Senior' years. Where is their condemnation? Is it the present HK government's poor education policy too?
Your mentality is the exact problem of today's youngsters. It is always someone else fault, never take responsibility of their own actions. And the supposed adults pamper them without correct directions.

I think their behavior is deplorable too, especially the girl's use of the lewd Cantonese word for sexual intercourse in a public forum.
Why the other legislators don't condemn them?
Because Hong Kong has become a polarized society. Whenever a politician does something utmost disgusting, politicians from the same camp would not condemn his/her behavior. Both camps exhibit such behavior.
我认为他们的行为是可悲的。尤其是在公开会议上用一些污言秽语,充斥着性交的广东话来攻击别人。
为什么没有立法委员来谴责他们?
因为香港成为了一个偏激的社会了吗。不论何时一个政客做出来一些令人极度厌恶的事情,同阵营的政客也不会谴责他们的行为。两个阵营都是如此。

But there is a big difference between 大是大非 issue and partisan politics.
The supposed educated virtuous adults should know the difference. Pampering these fools will only encourage them to radicalize more.
Unless these so-called democracy advocators are just as low to begin with.
In fact I think these young fools learned from the adult radicals who have no respect for the law and order.

These young new legislators are ignorant and most likely, they don't understand how derogatory the term &Chi-na& implies.
But the problem is who caused their ignorance?
The Hong Kong SAR government does not require Chinese History as a mandatory course in the High School curriculum. In fact, fewer and fewer students choose Chinese History as their core course. I can understand why the British colonial government didn't require it, but why does the SAR government follow suit?
这些年轻的立法委员真是蠢的可以。他们不知道“支那”这个词意味着有多么侮辱人。
但是是谁让他们这么蠢的?

Reading these comments is like watching the jailer argue with torturer about who looks after their charges better.
Do you seriously believe that anyone with a bit of knowledge and experience of the real world gives any of your BS any sort of credence whatsoever.
What you underestimate is the ability of people to have the conversations they want, regardless of what oppressive regimes, be they totalitarian or faux democratic, may wish.
Crawl back under your rocks and let those of us that want to have a conversation about what is happening communicate with each other.

So far no one from the so-called Democracy camp has come out to condemn the fools' 'Swearing and Insults'.
They acted like quails when the British governor was here, but act like vicious crows yelling their caw when the yappingCE is a Chinese. It really tells you their virtue level.

My previous post calling to push the idiot haters under the bus was removed by TE. Maybe TE thinks &push them under the bus& is literal while everyone knows it is figurative in political conversation.

Yep.. like they say, politicians, lawyers, used car salesmen are the same group of people. In fact, many of these opposition camp clowns in the Legco are lawyers.
If more of these fools radicalize further, We may end up with one country one system in 2047' lol...

China isn't moving slowly to become like Hong Kong, its more the reverse. Xi Jinping has consolidated more power to himself. Corruption hasn't really decreased.

The uncomfortable truth in many areas, Hong Kong would be better off if it was brought directly CPC rule.
If I were a Hong Konger I would trust CPC officials more than elites who are ruling Hong Kong today. They have so much personal conflict of interest that it would be better just to bring over some from Guangzhou.
In this comment section, most of the pro-Beijing Hong Kong posters are arrogant and deluded..Deep down most mainland Chinese would agree the notion that its just better to take over Hong Kong completely, and the Basic Law is a relic, they want to give their Hong Kong brethren some face.
The underlying assumption of the Basic Law is that its better than what China has. Its not actually better, its just different. If it was better, the PRC would have setup EEZ based on it. The fact is its more trouble than its worth, and its a poisoned chalice.
There are ways to ensure the rule of law is maintained without the LEGCO.You could scrape the LEGCO, and China would just send a mainlander. China should have setup a court of final appeal with Mainland/Hong Kong/ British judges. HK uses foreign judges so its no big deal. Its clear that HK people can't rule themselves.
There might be some hiccups in the beginning and maybe violence, but in the long run China will come up stronger.

有太多的个人利益冲突。他们应该从广州多学一些东西。
有种方法不需要立法会也能维护法制。比如解散立法会,然后中国送来一些大陆人。中国可以建立一个由英国,香港,中国的法官组成的终审法庭。
香港还使用外国人法官,所以这没有什么大不了。反正,香港人没办法自治这点很明白。
在一开始可能会有点不舒服,甚至可能会有些暴利,但是中国的治理将会逐渐坚实起来的。
